These Terms of Use (“Terms”) apply to your use of the HCSG website (the “Site”), operated by Home Care Services Group (“HCSG,” “we,” “us” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. Our services
HCSG provides virtual caregiver recruitment, scheduling and care coordination support to home care agencies. HCSG does not provide in-home care, medical care or medical advice. The Site describes our services. It is not an offer or contract. A client relationship begins only when HCSG and your agency sign a written services agreement, together with a Business Associate Agreement where HIPAA requires one. Those agreements, not these Terms, govern the services we provide.
2. Informational content only
The information on the Site, including service descriptions, figures and FAQs, is general information for home care agencies. It is not legal, compliance, employment, financial or medical advice.
- Figures such as fill rates, time savings and costs describe typical results and are not a guarantee of results for your agency.
- Rules for caregiver hiring, Electronic Visit Verification (EVV) and Medicaid change often, and the Site may not reflect the latest changes.
- Your agency remains responsible for its hiring decisions, client care and regulatory compliance.
Other names and logos on the Site belong to their respective owners, and their use does not imply endorsement.
3. Using the Site
You agree not to:
- Use the Site for any unlawful purpose or in a way that violates these Terms
- Try to gain unauthorized access to the Site, its servers or related systems
- Interfere with the Site’s operation, security or other users
- Submit false information, or information about another person without their permission
- Send spam, malicious code or automated form submissions
4. Information you submit
When you use a form on the Site, you agree to provide accurate business contact information. Do not submit protected health information (PHI) or any details about your clients or caregivers through the Site. We use the information you submit as described in our Privacy Policy.
5. Intellectual property
The Site and its content, including text, graphics, logos and design, are owned by HCSG or its licensors and protected by copyright and trademark law. You may view and share Site pages for your own informational, non-commercial use, with credit to HCSG. You may not copy, republish or sell Site content without our written permission.
6. Third-party links and services
The Site may link to or embed third-party services, such as Google Maps. We do not control and are not responsible for third-party websites, content or privacy practices. Your use of them is subject to their own terms.
7. Disclaimer of warranties
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, HCSG disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Site will be uninterrupted, error-free or free of harmful components, or that any staffing, scheduling or business outcome will be achieved.
8. Limitation of liability
To the fullest extent permitted by law, HCSG will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of revenue, profits, data or business, arising from your use of or reliance on the Site or its content. This does not limit any rights or obligations under a signed services agreement between HCSG and your agency.
9. Indemnification
You agree to indemnify and hold harmless HCSG from claims, losses and expenses, including reasonable attorneys’ fees, arising from your misuse of the Site or your violation of these Terms.
10. Governing law
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict of law rules. Any dispute about these Terms or the Site will be brought in the state or federal courts located in New Jersey, and you consent to their jurisdiction.
11. Changes to these Terms
We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. Continuing to use the Site after a change means you accept the updated Terms.
